Terms & conditions

COMMITMENT 

Regularly attending Kinesiology sessions, performing pre-work and tasking activities, as well as home reinforcement exercises, are essential to achieve results and it is the expectation of Kinesiology Co. that every client takes personal responsibility for achieving their stated health and wellbeing goals.

 

By purchasing any Kinesiology Co. products, or services, you (the client) acknowledge the importance of and agree to make a commitment of time to the improvement of your mental, physical and emotional excellence. 

 

In order to achieve results, clients are required to:

  1. Commit to regular sessions as advised by your practitioner

  2. Follow the instructions and advice provided your practitioner during a session

  3. Commit to a healthy lifestyle outside the session, ensuring you follow instructions with regard to home reinforcement exercises that compliment your goals and program, including, but not limited to healthy eating and rest and exercise guidelines.

 

SERVICE AND SUPPORT

At Kinesiology Co. we offer comprehensive and supportive Kinesiology services to suit your health and wellbeing needs.  These include the following: 

 

Initial Session

When we refer to an “Initial Session” we mean that the client has not preciously attended a session or participated in a full medical head-to-toe assessment with the practitioner. 

 

Session Duration

Session durations can be expected to be as follows:

  • Initial session – first session including intake assessment is 1.5-2 hours duration 

  • Ongoing sessions – followup session or ongoing maintenance session of 1 hour duration 

Please note: All sessions may be extended due to client need and only at practitioner discretion.

Post-session and Customer Service Support 

Following a Kinesiology session it is not uncommon to experience changes at the physical, emotional or mental level.  Symptoms may range from: â€‹

  • emotional upsets

  • tiredness

  • increased energy

  • feelings of relief

  • lightness in the body.  

As your health and welfare is of primary importance, we will prioritise our response to any questions or concerns you may have about a session or anything you may experience following a session.  

You agree it is your full responsibility to initiate contact with the practitioner to seek information and assistance in these instances.

Preparation

In order to make the most from your session it is important that you prepare in the following ways: 

Clothing and footwear

  • Wear loose fitting attire that is suitable for stretching and that allows full range of motion, including, but not limited to: t-shirts, shorts, tights, leggings and tracksuits.

Tasking

  • You must agree to any and all tasking before you are given the task.

  • It is the sole responsibility of the client to complete all tasking as directed prior to their appointment.

  • Tasking is part of the session and as such the session effectively begins upon acceptance of the task.

  • There will be no refund of session fees once a task has been accepted.  

  • Your session will not proceed if the task has not been completed.

  • You will be liable for all session fees as per the cancellation policy for any sessions cancelled due to incomplete tasking. 

 

Payment and Pricing

Kinesiology Co. is committed to helping you achieve personal success and establish health and wellbeing as a permanent part of your lifestyle.

 

To ensure this, we may ask that each session be paid for: 

  • In full prior to or directly after the session on the day of the service.

  • For your convenience, we accept payment by: cash, and credit card.

  • If you are a member of a participating Private Health Insurance provider and have kinesiology, or remedial massage as part of your Ancillary cover, you may be able to claim rebates from your provider.  Please confirm this directly with your provider.

 

From time to time we may make variations to our pricing and product offerings and as such, we:

  • Retain the right to discontinue any offer, product or group of products at any time without notice

  • Guarantee to honour and deliver in full any and all products purchased prior to an offer being discontinued.

 

Cancellation and Late Policy

To ensure your Kinesiology session is on time, our services run smoothly for all our clients, everyone has fair and equitable access to our services and we can continue to provide the best possible service for you into the future, we have the following cancellation and late policies:

 

Cancellations

  • As a courtesy, we will always send you a confirmation email for all sessions you book and reschedule, as well as a reminder email or text message prior to your session.

  • We therefore ask that you give us 24 hours notice in ALL instances where you need to cancel your session.

  • We understand unexpected emergencies can occur, and will not charge a cancellation fee the first time this happens.

  • All further short notice cancellations will incur the FULL cost of the session as a cancellation fee, as short notice cancellations prevent us from offering the session to other clients who may need it. 

  • We will, however, waive the cancellation fee where you reschedule and attend another appointment in the same week.

  • In the event of ongoing late notice cancellations, rescheduling of missed sessions will be at the sole digression of the practitioner.

  • No further appointments will be booked if you have outstanding cancellation fees.

  • We will always make every effort to give you 24 hours notice if your practitioner needs to cancel a session - excluding emergencies, or natural, or other disasters that make the clinic environment dangerous for the client and are beyond the control of the practitioner.

Illness, Injury and Reduced Capacity

  • We do not recommend you attend a Kinesiology session when sick, injured, or in any other way of reduced capacity.

  • Your practitioner will respect your health and wellbeing and will give you 24 hours notice if they are unable to attend a session due to illness.

  • Clients must not be under the influence of any medication, drugs, alcohol, or any other substance that might either adversely impact or enhance their abilities.

  • If a client presents to a session with a contagious illness, or under the influence of drugs, alcohol or any other substance, or in any other way that the practitioner deems unsafe, they may cancel the session at their full discretion, as per the cancellation policy.

 

Late Policy

  • If you are late for your session, your session MUST still finish on time.

  • Your practitioner will make the most of the shortened session time, however, any rescheduling or extension of time will be at the sole digression of the practitioner.

  • If your practitioner is running late to a session, they will endeavour to extend your session by the same amount of time as appropriate. 

 

Refunds

A full refund will be provided for any unused, pre-paid sessions cancelled with 24 hours notice – minus any processing fees.

Refunds will be processed as follows: 

  • Where possible, the refund will be processed within 24 to 48 hours of receipt of written notice of cancellation by the client.

  • All refunds will be made via direct debit, regardless of the original method of payment used for the purchase, and will be subject to the timeframes, fees, charges, and any other requirements of the financial institutions/organisations involved in the transaction.

 

Complaints

We aim to provide the highest quality health care and are committed to being responsive to the needs and concerns of our customers and resolving any complaints as quickly and effectively as possible. If you are dissatisfied with any service provided by us you should: 

  • Speak directly with your practitioner in the first instance.

  • If you feel uncomfortable discussing the matter directly with your practitioner, you can lodge a complaint in one of the following ways:

    • Completing a feedback survey if one has been emailed to you.

 

Expected response times to all customer service enquiries will be within 24 hours of receipt of the enquiry.  

 

If you are not satisfied with the resolution provided by Kinesiology Co. you may provide your complaint in writing to the Australian Kinesiology Association (AKA), at: enquiries@aka.asn.au

 

Privacy

At Kinesiology Co. your personal privacy and security is of paramount concern and while we will collect your personal information for the purpose of contacting you and helping you reach your health and fitness goals we will not share, sell or divulge these details, without your prior written permission.  This includes, but is not limited to: 

  • Contact details

  • Banking details

  • Session times

  • Details of your progress and sessions

  • Any information discussed during sessions.

 

Intellectual property

Any and all intellectual property that is part of a Kinesiology session, provided as verbal instruction, or guidance supplementary to the session, or made available through the business’ online presence, or ongoing relationship between the client and practitioner, remains the intellectual property of Kinesiology Co., to the extent that: 

  • Any intellectual property of Kinesiology Co. is not to be replicated, reproduced, or shared in any form, or for any reason, without the prior express permission in writing of the owner of Kinesiology Co., unless the property was created expressly for the purpose of sharing, and proper attribution is given to the author.

  • The intellectual property of Kinesiology Co. includes, but is not limited to:

    • Web content and written articles of any nature

    • Presentations

    • Marketing material and strategy

    • Designs, artwork, presentation, packaging and format

    • Business processes, systems, tools and operating procedures

    • Any and all nutritional coaching strategies, advice, programs and articles

    • Any and all fitness instruction or programming (circuits, cardio, weight training, boot camps, yoga and stretching, or other fitness, or physical wellness sessions produced by, or in collaboration with Kinesiology Co.)

    • Any other material or advice associated with health and fitness instruction or business management provided by Kinesiology Co. across any communication channel or platform.

 

Kinesiology Co. expressly reserves all copyright and trademark in all hardcopy and electronic documents, information, materials and practices that may be accessed either via our website, social media presence, or as the result of a session, or workshop.

Distribution, reproduction, replication, sharing, or otherwise distributing the intellectual property of Kinesiology Co. is notpermitted under any circumstances without the express permission in writing of the owner of the business.  

 

We reserve the right to take action against any person, business, or other entity engaging in either commercial, or non commercial exploitation of the intellectual property of Kinesiology Co., or breaching any of these terms.

 

GENERAL AGREEMENT

By purchasing Kinesiology Co. products and services, you (the client) acknowledge that you have fully read, understood and agree to the contents of the Kinesiology Co. terms and conditions, your rights and responsibilities therein, and that this release cannot be modified verbally.

 

By using our services, you agree that Kinesiology Co. is not to be held liable for any decisions you make based on any of our services, or guidance, and any consequences as a result are your own. Under no circumstances can you hold Kinesiology Co. liable for any actions you take, nor can you hold us or any of our employees liable for any loss or costs incurred by you as a result of any guidance, advice, coaching, materials, or techniques used or provided.  Kinesiology Co. takes no responsibility for your actions, choices or decisions.

 

You understand and agree that Kinesiology and NLP are Complementary Health Care therapies and that all information provided on the website, in consultations and in any other form, in no way constitutes, or acts as a substitute for the advice of a registered medical professional, nor does it constitute financial or legal advice of any kind. 

 

Results from Kinesiology and NLP processes are the sole responsibility of the client and are not guaranteed.

 

JURISDICTION

This agreement and this website are subject to the laws of South Australia and Australia. If there is a dispute between you and Kinesiology Co. that results in litigation, then you must submit to the jurisdiction of the courts of SA.
